Thailand formalizes regulations for the use of hemp in cosmetics
Over 2020, Thailand reformed several regulations relating to cannabis and hemp activities including approved of the use of cannabis for medical uses and research purposes.
On January 11, 2021, the Ministry of Public Health of Thailand or the MOPH announced the Ministerial Notification Re: Use of Hemp in Cosmetics B.E. 2564 (A.D. 2011) or the Notification, which allows the use of hemp and hemp-derived products for cosmetic products under the condition that such products must contain less than 0.2% of THC by weight or the amount as specified in the table attached to the Notification.
For the registration process of cosmetic products that contain hemp seed oil or hemp seed extract, the Food and Drug Administration of Thailand (“FDA”) requires an applicant to submit an application and attach supporting documents including a certificate of analysis, safety data sheet, and label for the agency’s evaluation etc. In addition, the amount of hemp seed extract or hemp seed oil used in cosmetics products shall be accurately declared in the application for product registration and such product shall not bear reference to any prohibited narcotic substance. The name of cosmetic product is also restricted to contain any references to any prohibited narcotic substances.
According to the Notification, importing of hemp seed oil or hemp seed extract including any cosmetic containing those substances into Thailand is restricted.
