The topic covers the compliance with the law of Thailand to install the fire alarm system in industrial factory to ensure that safety standards are met. There are three main regulations governing the issues of installation of fire alarm system in a factory located in Thailand.
The first regulation is the ministerial regulation issued pursuant to the Building Control Act B.E. 2522 (A.D. 1979). This regulation stipulates the owner of the factory building, with the combined area of every floor in the same building exceeding 2,000 square meters, to install a fire alarm system on every floor. Such installation shall contain both an automatic and manual system. From the interpretation of this regulation, the regulation imposes the duty to the owner of the factory building to install the fire alarm system. However, in case of lease agreement of the factory building, the contracting parties may agree otherwise on the duty to install the fire alarm system.
The second regulation is the ministerial regulation issued pursuant to the Occupational Safety, Health and Environment Act B.E. 2554 (A.D. 2011). This regulation imposes the duty to install both the automatic and manual fire alarm system on to the employer, who has the areas of business operation exceeding 300 square meters or the building of 2 or more floors.
The third regulation is the notification issue pursuant to the Factory Act B.E. 2535 (A.D. 1992). The notification indicates that the Factory building shall arrange the fire detection and fire alarm device for the entire building as appropriate to the area conditions. For the area where there are no regular workers and have the electronic equipment installed or flammable or combustible materials stored, the factory shall install the automatic fire detection and alarm device. This notification imposes duty on the factory building, which can be implied as it is the duty of the lessor. However, the contracting parties may agree otherwise on the duty to install the fire alarm system.
