Under the new regulations, businesses that offer condominium units for reservation must comply with the standard contract format. This contract must be:
- Written in Thai in a clear and legible manner.
- Printed in font size no smaller than 2 millimeters, with no more than 11 characters per inch to ensure readability.
- Issued in duplicate, with one copy provided to the consumer immediately upon signing.
For businesses selling condominium units through electronic channels, the reservation contract must also conform to the Electronic Transactions Act, ensuring that consumers can easily read and understand the contract terms online. Additionally, digital platform operators acting as intermediaries in the sale of reserved condominium units must provide consumers with a copy of the standard reservation contract.
Prohibited Unfair Contract Terms
The regulation explicitly prohibits unfair contract clauses that could place consumers at a disadvantage. These include:
- Exempting or Limiting Business Liability – Any clause that absolves the business from responsibility for breach of contract is not allowed.
- Unilateral Contract Modification – Businesses cannot alter contract terms in a way that imposes additional burdens on consumers.
- Termination Without Notice – The business cannot terminate the contract without written notice unless the consumer is in breach.
- Unjust Retention of Payments – Businesses cannot retain all or part of the consumer’s payment unless the consumer is at fault.
- Control Over Reservation Deposits – The business cannot impose terms requiring consumers to make excessive deposits or similar payments beyond reasonable industry standards.
- Charging Consumers for Transfer of Reservation Rights – Businesses are not permitted to charge consumers additional fees for transferring reservation rights.
- Unfair Use of Common Property – The business cannot reserve exclusive rights over shared condominium facilities for its own benefit.
- Unauthorized Use of Consumer Data – Businesses must comply with personal data protection laws and obtain consent before collecting, using, or disclosing consumer information.
