New Ministerial Regulation issued by Department of Industrial Works

The Department of Industrial Works (“DIW”) has issued the new Ministerial Regulation Re: Odour Control Standards and Methods for Industrial Facilities B.E. 2568 (“Regulation”), which was published in the Government Gazette on 27 March B.E. 2568 and will come into effect on 25 May B.E. 2568. The Regulation repealed the Ministerial Regulation Re: Standards and Methods for Odour Detection in Air Emissions from Factories B.E. 2548.

Odour Concentration Standards
The Regulation stipulates that the air discharged from factories listed in items 1 to 22 and item 24 must meet the following odour concentration standards:

  1. For the factories located within an industrial zone, the odour intensity at the boundary or perimeter of the factory shall not exceed 30, or the odour intensity at the factory’s exhaust stack shall not exceed 1,000; and
  2. For the factories located outside an industrial zone, the odour intensity at the boundary or perimeter of the factory shall not exceed 15, or the odour intensity at the factory’s exhaust stack shall not exceed 300.

For the factories listed in item 23, which are located within an industrial zone or outside an industrial zone, the odour intensity at the boundary or perimeter of the factory shall not exceed 30, or the odour intensity at the factory’s exhaust stack shall not exceed 2,500.

Odour Intensity Measurement Method
The measurement of odour intensity under this Ministerial Regulation shall be conducted using the sensory test method.
