The Office of the Consumer Protection Board (“OCPB”) has announced that car and motorcycle rental services are classified as “contract-controlled businesses” under the Contracts Act B.E. 2568 (2025), which will take effect on December 30, 2025.
Purpose of the Law:
The new regulation aims to protect consumers from unfair practices in vehicle rental contracts. It requires all operators to use a standardized, transparent, and fair contract form, ensuring that all terms are clear, complete, and easy to understand, while eliminating unfair conditions.
Key Provisions:
- Rental contracts for cars and motorcycles must be written in Thai, using clear and straightforward language with no hidden clauses.
- Unfair contract terms that limit the operator’s liability or impose unreasonable burdens on consumers are prohibited.
- Contracts must clearly specify all costs and expenses, including fees, penalties, and any financial obligations, in a transparent manner.
- Operators who fail to comply will face penalties as prescribed by law.
OCPB’s Position:
Mr. Nontharong Phulphiphat, the Secretary-General of the OCPB, described this as a “major turning point” for Thailand’s rental industry — marking the first time such businesses are brought under a contract control system. The goal is to ensure fairness, reduce disputes, and build long-term consumer confidence.
He urged all car and motorcycle rental operators nationwide to study and adopt the new standard contract as soon as possible to ensure compliance before the law takes effect.
