On 2 September 2024, the Food and Drug Administration of Thailand (“FDA”) opened for a public hearing on the Draft Notification of the Ministry of Public Health Re: Exempting the Importation of Certain Substances from Compliance with the Hazardous Substances Act B.E. 2535 (1992) under the Responsibility of the Food and Drug Administration B.E. … (“Draft”).
The purposes of this draft notification for which the importation of hazardous substances is exempt from complying with the Hazardous Substances Act are as follows:
- Hazardous substances imported for personal use;
- Hazardous substances imported for specific occasional purposes;
- Hazardous substances imported for exhibition purposes;
- Hazardous substances imported for foreign film production in Thailand;
- Hazardous substances imported for use in the operations of agencies or for transfer to agencies that must adhere to international standards for the use of hazardous substances; and
- Hazardous substances imported for transfer to ministries, departments, local administrative organizations, state enterprises, public organizations, the Thai Red Cross Society, the International Red Cross Committee, international organizations under the laws protecting the operations of the United Nations and specialized agencies in Thailand for use in their operations.
However, the importation of hazardous substances that are exempt from compliance must still follow the regulations, conditions, and submit the required documentation for importation.
This draft notification shall come into force from the day following the date of its publication in the Royal Gazette onwards and repeals the Notification of the Ministry of Public Health Re: Exempting Importation from Compliance with the Hazardous Substances Act B.E. 2535 (1992) Regarding Notification of Operations, Licensing, and Registration of Hazardous Substances under the Authority of the Food and Drug Administration B.E. 2548 (2005) dated 27 October B.E. 2547 (2004).
