On 19 September 2024, the Department of Industrial Work (“DIW”) held a public hearing on the draft on the notification re: criteria, methods, and conditions for advertising hazardous substances (“Draft”).

The draft primarily focuses on requirement on the advertisement of the hazardous substances to include instructions and warning signs regarding usage or potential dangers. In other words, the advertisement shall provide complete and clear instructions on the use of hazardous substances, ensuring there are no ambiguous or misleading statements about the information regarding the hazardous substances, which could lead to inappropriate dangers.

Apart from the instructions and warning signs, the advertisement shall also include the name of the hazardous substance, usage ratio, utilization of hazardous substances as well as the warning signs such as pictograms, signal words, or hazard statements.

The Draft includes the list of hazardous substances, i.e., cadmium cyanide, zinc cyanide and propionitrile, that are prohibited from being advertised through electronic means, radio media, television media, online media, websites, and digital platforms.
